{"id":1820,"date":"2017-01-31T12:12:17","date_gmt":"2017-01-31T20:12:17","guid":{"rendered":"https:\/\/drugtestsinbulk.com\/blog\/?p=1820"},"modified":"2021-01-18T11:58:48","modified_gmt":"2021-01-18T19:58:48","slug":"marijuana-laws-changing","status":"publish","type":"post","link":"https:\/\/drugtestsinbulk.com\/blog\/marijuana-laws-changing\/","title":{"rendered":"State Marijuana Laws Are Changing But Employer Attitudes, Federal Law Aren\u2019t"},"content":{"rendered":"<p>Changing <span id=\"urn:local-text-annotation-ss44pd6xvz0pfi6u73h1fko6rjvvcyp9\" class=\"textannotation disambiguated wl-thing\">marijuana laws<\/span> aren\u2019t necessarily making weed more welcome in the <span id=\"urn:local-text-annotation-vb57qz90yvlc57ikg3hknjyvixy7e26h\" class=\"textannotation disambiguated wl-thing\">workplace<\/span>.<\/p>\n<p>For now, many <span id=\"urn:local-text-annotation-ezeqedzoxmyjvxwv26426gvijjarsf9n\" class=\"textannotation disambiguated wl-thing\">employers<\/span> appear to be sticking with their <span id=\"urn:local-text-annotation-aldc72oiq5inae437adbihpvi72uun1m\" class=\"textannotation disambiguated wl-thing\">drug testing<\/span> and personal conduct policies, even in states where <span id=\"urn:local-text-annotation-fot43r5x6zp29wa70yoypn9udii93h9j\" class=\"textannotation disambiguated wl-thing\">recreational marijuana<\/span> use is now permitted. Others are keeping a close eye on the still evolving legal, regulatory and political environment.<\/p>\n<p>Voters in California, Massachusetts, Maine and Nevada voted Nov. 8 to approve the use of <span id=\"urn:local-text-annotation-xhlliana0jvy1v4f2cid4pldieoqrxbf\" class=\"textannotation disambiguated wl-thing\">recreational marijuana<\/span>, joining Colorado, Washington, Oregon and Alaska, where it had previously been legalized. (A recount of Maine\u2019s close result is scheduled.) You can still be drug tested. And you can still be fired \u2013 or not hired \u2013 for failing a <span id=\"urn:local-text-annotation-cfbtgiwxugx4iypprn7yqr529tntu855\" class=\"textannotation disambiguated wl-thing\">drug test<\/span> even if you\u2019re not the least bit impaired at work.<\/p>\n<p>All the states with legalized recreational <span id=\"urn:local-text-annotation-344f2mjk8tqlqeddsq22pm0a4ix7nble\" class=\"textannotation disambiguated wl-thing\">pot<\/span> have exemptions for <span id=\"urn:local-text-annotation-qt4sfi8pq9tp4160g0dswz5mie9sfwg6\" class=\"textannotation disambiguated wl-thing\">workplace<\/span> drug policies.<\/p>\n<p>In Massachusetts, for example, the law includes language stating that \u201cthe authority of <span id=\"urn:local-text-annotation-xnogrsu58u2iq0pqvfmxcg14io4oqt5j\" class=\"textannotation disambiguated wl-thing\">employers<\/span> to enact and enforce <span id=\"urn:local-text-annotation-7339v8m7cjjtdsnse8tg00ms4im1u3do\" class=\"textannotation disambiguated wl-thing\">workplace<\/span> policies restricting the consumption of marijuana by <span id=\"urn:local-text-annotation-qk2co34vvhtlqhz2z5q8jv2t9cc0zafv\" class=\"textannotation disambiguated wl-thing\">employees<\/span>\u201d is not changed.<\/p>\n<p>\u201cYes, you may be able to have (marijuana) at home, but that doesn\u2019t mean it\u2019s OK in the <span id=\"urn:local-text-annotation-xwj0cd8i4p2ffqb4l8r5291x3mw8enj0\" class=\"textannotation disambiguated wl-thing\">workplace<\/span>,\u201d said Edward Yost, an HR specialist with the Society for <span id=\"urn:local-text-annotation-ls7p7d26x8g0n3wchg5rssjorts9tsqx\" class=\"textannotation disambiguated wl-thing\">Human Resources Management<\/span>.<\/p>\n<h6><strong>WHAT ABOUT WORKPLACE SAFETY?<\/strong><\/h6>\n<p>Advocates for <span id=\"urn:local-text-annotation-oco03vtpr8lp18go8qzq1714ijx0h18o\" class=\"textannotation disambiguated wl-thing\">marijuana legalization<\/span> said it was never their intention to compromise safety, a central reason offered by <span id=\"urn:local-text-annotation-25hp988nepuype2bwoy8drt3xrg4iisd\" class=\"textannotation disambiguated wl-thing\">employers<\/span> for <span id=\"urn:local-text-annotation-2jlw1m0atldwl60z8e01fywrk9cu9jzn\" class=\"textannotation disambiguated wl-thing\">drug testing<\/span>.<\/p>\n<p>\u201cWe don\u2019t want anyone to come to work impaired on any drugs,\u201d said David Boyer, campaign manager for the ballot initiative in Maine.<\/p>\n<p>A 2013 survey by the employee screening firm HireRight found 78 percent of <span id=\"urn:local-text-annotation-iex7uxnpae7x9dv4463s7nwmioagpq8i\" class=\"textannotation disambiguated wl-thing\">employers<\/span> conducted <span id=\"urn:local-text-annotation-7nrjp6l2v85v952uge9flp7gb9cly4gq\" class=\"textannotation disambiguated wl-thing\">drug tests<\/span> either randomly, as a condition of <span id=\"urn:local-text-annotation-doraith3sswxuuvphbc2chaorx8f60n2\" class=\"textannotation disambiguated wl-thing\">employment<\/span>, after accidents or for some combination of those reasons.<\/p>\n<p>The federal government requires <span id=\"urn:local-text-annotation-a7nbcp5anb2qy2ntpiqjqt1emi8frjqu\" class=\"textannotation disambiguated wl-thing\">drug testing<\/span> for some workers, including truck drivers and others in transportation.<\/p>\n<p>Quest Diagnostics, which performed nearly 11 million laboratory-based <span id=\"urn:local-text-annotation-wb6nkhs1icsnz2bpbr2c07lditqwrl2v\" class=\"textannotation disambiguated wl-thing\">drug tests<\/span> for <span id=\"urn:local-text-annotation-4d544noy5h4ist55lhaicc8frc1taibp\" class=\"textannotation disambiguated wl-thing\">employers<\/span> in 2015, said the percentage of tests coming back positive has shown a modest increase in recent years. Nearly half of all positive tests showed evidence of marijuana use.<\/p>\n<h6><strong>CAN I GET FIRED EVEN IF I\u2019M NOT HIGH?<\/strong><\/h6>\n<p>THC, the psychoactive chemical in <span id=\"urn:local-text-annotation-sxbj57xj4wd3gufn9mxzxs9k9k0rdux0\" class=\"textannotation disambiguated wl-thing\">cannabis<\/span>, can stay in a person\u2019s system for days or even weeks, experts say \u2013 long after the buzz has subsided.<\/p>\n<p>\u201cIt\u2019s the equivalent of firing somebody who drank a glass of wine on Friday evening and then came to work on Monday,\u201d said Tamar Todd, legal director for the <span id=\"urn:local-text-annotation-2synu8b7ief7bknuvv98z7iudinr50f8\" class=\"textannotation disambiguated wl-organization\">Drug Policy Alliance<\/span>, who believes <span id=\"urn:local-text-annotation-ci62z1jl2wqcttpzd4g5sif6rr17esvk\" class=\"textannotation disambiguated wl-thing\">employers<\/span> should reconsider zero-tolerance policies in light of changing laws and attitudes.<\/p>\n<p>A number of efforts are underway to develop an accurate method, akin to the Breathalyzer for alcohol, to measure actual marijuana impairment. Such a test might be useful not only for <span id=\"urn:local-text-annotation-o3tb5isy0q1s9jc5v78pvi5q9h5j8kw9\" class=\"textannotation disambiguated wl-thing\">employers<\/span>, but also for police and prosecutors trying to determine what constitutes driving under the influence of marijuana in states where recreational <span id=\"urn:local-text-annotation-emomupoxynt3j4kn6kbwng66ri9c5k0j\" class=\"textannotation disambiguated wl-thing\">pot<\/span> is legal.<\/p>\n<h6><strong>WHAT SHOULD COMPANIES DO?<\/strong><\/h6>\n<p>At a minimum, companies should review their current polices, make sure their managers are trained and make clear to <span id=\"urn:local-text-annotation-3ndxg8m4jhv3qxflaq2cblnmiehsp0b3\" class=\"textannotation disambiguated wl-thing\">employees<\/span> that marijuana use on or off the job can still land them in trouble, said James Reidy, a New Hampshire-based attorney who advises clients around the country on <span id=\"urn:local-text-annotation-nnlxhx31nifh3sx28jsxxbt9x8mhnmwj\" class=\"textannotation disambiguated wl-thing\">drug testing<\/span> issues.<\/p>\n<p>Tina Sharby, chief human resources officer for an Easter Seals affiliate with about 1,700 <span id=\"urn:local-text-annotation-wx1kxo2f9dr7mgwvierssjor2bnyievi\" class=\"textannotation disambiguated wl-thing\">employees<\/span> in New England, said the organization, which provides services for people with special needs, is monitoring the evolving legal and regulatory environment but is sticking with its <span id=\"urn:local-text-annotation-fk2yuvw148njq8pbk8nmp4aemi92kmmw\" class=\"textannotation disambiguated wl-thing\">drug testing<\/span> protocols for now.<\/p>\n<p>\u201cWe have a drug-free <span id=\"urn:local-text-annotation-v7xth946khrato66z6qd7vi7fu2mv2wd\" class=\"textannotation disambiguated wl-thing\">workplace<\/span> policy, and we believe that the current policy we have is effective,\u201d Sharby said.<\/p>\n<p>But <span id=\"urn:local-text-annotation-538ldw0dwql8atw0jcao72e299j28hdc\" class=\"textannotation disambiguated wl-thing\">drug testing<\/span> and zero-tolerance rules can also make it difficult for businesses with a need to recruit young professionals who may harbor more liberal attitudes toward <span id=\"urn:local-text-annotation-wqg5lokx3fyhwvaziqxzdunmidfg0ljx\" class=\"textannotation disambiguated wl-thing\">pot<\/span>.<\/p>\n<p>\u201cWe have ski industries out here, and if they really took a hard line on marijuana use, they would have to shut down,\u201d said Curtis Graves, information resource manager for the Colorado-based Mountain States Employers Council.<\/p>\n<p>After Colorado became the first state to legalize <span id=\"urn:local-text-annotation-l3medwzd40z5v2laz6pnl8frsopheeld\" class=\"textannotation disambiguated wl-thing\">recreational marijuana<\/span> in 2012, surveys showed an uptick in <span id=\"urn:local-text-annotation-7qwivsauzf1ymmg4u812ejc3diasw9sb\" class=\"textannotation disambiguated wl-thing\">workplace<\/span> <span id=\"urn:local-text-annotation-sb40lt1vsjhv8xxahp2hme7b9frm4aoh\" class=\"textannotation disambiguated wl-thing\">drug testing<\/span>, Graves said, but that trend has begun to shift in the other direction.<\/p>\n<p>\u201cEmployers who have a zero-tolerance policy maybe shouldn\u2019t apply that to non-safety sensitive workers, because if they do testing on them, they run the risk of inviting an invasion of privacy claim,\u201d suggested Amanda Baer, a Boston-area attorney who specializes in labor and <span id=\"urn:local-text-annotation-9ny7hfdnfcv1n9qv64c8h69a4imv1st3\" class=\"textannotation disambiguated wl-thing\">employment<\/span> issues.<\/p>\n<h6><strong>WHAT DO THE COURTS SAY?<\/strong><\/h6>\n<p>Adding to the uncertainty is the scarcity of legal precedent in states that have legalized <span id=\"urn:local-text-annotation-i5pinvzbtlce9voy3nkwc23xrhtomn0d\" class=\"textannotation disambiguated wl-thing\">recreational marijuana<\/span>. But several cases involving <span id=\"urn:local-text-annotation-lugn2llej2uiimelwfxadzpviwemb4xa\" class=\"textannotation disambiguated wl-thing\">employees<\/span> with permits to use <span id=\"urn:local-text-annotation-hem3efe0h8806cdterh82rzfreeudgxo\" class=\"textannotation disambiguated wl-thing\">medical marijuana<\/span> have reached the courts, and most have been decided in <span id=\"urn:local-text-annotation-vt2lecdb6h9eqp0y0c41pds4iye2d821\" class=\"textannotation disambiguated wl-thing\">employers<\/span>\u2019 favor.<\/p>\n<p>The most widely cited case is a 2015 Colorado <span id=\"urn:local-text-annotation-we8xlfcrbr1hoca58hvj3v7viy9qmld8\" class=\"textannotation disambiguated wl-thing\">Supreme Court<\/span> that upheld Dish Network\u2019s firing of a disabled man who used <span id=\"urn:local-text-annotation-yhtxlpe9whsweoh3dx4m42t9g1qzli2v\" class=\"textannotation disambiguated wl-thing\">medical marijuana<\/span> and failed a <span id=\"urn:local-text-annotation-kk7izm8z787myueuyl60w9udibwbwaaa\" class=\"textannotation disambiguated wl-thing\">drug test<\/span>. The court ruled that a state law barring <span id=\"urn:local-text-annotation-m9inbg5joe0p03h7zfuk57b9fpqg2c1o\" class=\"textannotation disambiguated wl-thing\">employers<\/span> from firing workers for off-duty behavior that is legal did not apply because <span id=\"urn:local-text-annotation-oz7408svmx62231jptudkuik9qb9vyu4\" class=\"textannotation disambiguated wl-thing\">pot<\/span> remains illegal under <span id=\"urn:local-text-annotation-saw93n70o6dsxziwwtphqia4i0t9wzg6\" class=\"textannotation disambiguated wl-thing\">federal law<\/span>.<\/p>\n<p>Similar rulings have been issued in other states including California, Montana and Washington.<\/p>\n<p>As <span id=\"urn:local-text-annotation-u4vp9nz0in1n8722ma9ti6bt9lpxezxp\" class=\"textannotation disambiguated wl-thing\">medical marijuana<\/span> programs become more common even in states where recreational <span id=\"urn:local-text-annotation-h6us50821j1obg81flvfpf1ort43eub3\" class=\"textannotation disambiguated wl-thing\">pot<\/span> remains outlawed, some companies have begun to weigh accommodations for workers with permission to use marijuana for an existing health condition.<\/p>\n<div class=\"copyright-notice lite\"><\/div>\n<div class=\"copyright-notice lite\"><em>Copyright 2017 Associated Press.
